Jefferson County Clerk Pursues Legal Clarity on Voter Registration Changes Along County Border
 
LOUISVILLE, Ky. — The Jefferson County Clerk's Office is taking legal action to seek judicial guidance regarding the recent reassignment of 211 voters from 137 addresses, primarily in the Willow Creek subdivision and surrounding areas along the Jefferson-Oldham County border.

 

The voter registration updates resulted from a statewide review conducted pursuant to guidance issued by the Kentucky State Board of Elections using Kentucky's Geographic Information System (GIS) mapping framework. As part of that process, election officials reviewed voter registration records to ensure they aligned with the official election maps used across the Commonwealth.Under the statewide GIS mapping framework established by Kentucky law, certain residences were identified as being located within Jefferson County for election administration purposes, resulting in voter registration updates by local election officials.
 
Jefferson County Clerk David Yates is filing a Petition for a Declaration of Rights so the court can provide guidance regarding the duties of election officials, the rights of affected voters, and the legal effect of election residency determinations when those determinations appear inconsistent with other governmental records.

 

"My office has a responsibility to maintain accurate voter registration records and to follow Kentucky election law," said Clerk Yates. "At the same time, residents have raised legitimate questions that deserve clear answers and a fair process. Rather than have election officials resolve those questions independently, I believe the courts are the appropriate forum to provide clarity, consistency, and confidence for everyone involved."

 

Legal Action
After discussions with local, county, and state officials, Clerk Yates determined that judicial guidance is appropriate regarding the responsibilities of election officials, the rights of affected voters, and the legal framework governing election residency determinations.
 
The questions presented are significant because Kentucky's election system relies upon statewide GIS mapping data used across all 120 counties. The outcome could provide guidance to election officials throughout the Commonwealth when questions arise regarding county residency for election purposes.

 

GIS Technology
Kentucky's election mapping framework utilizes GIS technology intended to identify jurisdictional boundaries and voting districts with greater precision and consistency across the Commonwealth. As a result of that review process, election officials updated voter registrations for certain residents who were identified as residing within a different county for election purposes than previously understood.

 

The review identified additional voters along Jefferson County's borders with neighboring counties, including Hardin County, Spencer County, and Bullitt County.

 

The boundaries used for election administration are available through the Kentucky Geography Network, a public website providing GIS resources, aerial photography, and topographical mapping information. Additional information can be found at https://kygeonet.ky.gov.

The voter registration updates have already been implemented to ensure election records reflect the official election maps currently used for election administration. Impacted voters will receive information regarding voting assignments, precincts, and voting locations.

 

The Jefferson County Clerk's Office recognizes that some residents have expressed concerns because other governmental records, services, or assignments may not align with their election residency designation. Residents have raised understandable questions regarding taxation, school assignments, county services, property records, and election administration.

 

The purpose of the legal action is to obtain a clear and transparent legal framework so those questions can be addressed by the appropriate governmental entities.
